Nothing in the terms shall limit or exclude Fulcrum HR Consulting for gross negligence or intentional misconduct of Fulcrum HR Consulting or its employees for death or personal injury.

If any part of this Limitation of Liability is found to be invalid or unenforceable for any reason, then the aggregate liability of Fulcrum HR Consulting (and any other person or entity whose liability would otherwise have been limited) for liabilities that otherwise would have been limited shall not exceed $10.00.

The Limitations and Exclusions apply to the maximum extent permitted by applicable law in your jurisdiction. Some jurisdictions do not allow the Limitation of Liability, so this Limitation may not apply to you.

Separate Agreements

You may have other agreements with Fulcrum HR Consulting. Those agreements are separate and in addition to these Terms of Use. These Terms of Use do not modify, revise or amend the terms of any other agreement you may have with us.

Severability

If any provision of these Terms of Use is held invalid, unenforceable, or void by a court of competent jurisdiction, these Terms of Use shall be considered divisible as to such provision, and the remainder of these Terms of Use shall be valid and binding as though such provision were not included in these Terms of Use.

Governing Law and Jurisdiction

These Terms of Use shall be governed by the laws of the State of Illinois (without regard to the laws that might be applicable under principles of conflicts of law). Any action related to or arising from this Agreement shall take place exclusively in the courts situated in Cook County, Illinois and the parties hereby submit to the venue of the courts situated therein.
